Terms of Service

These Terms of Service (“Terms”) define the rules for using the ercoding.pl website (“Service”) operated by ZS Nieruchomości Sp. z o.o. 68-200 Żary, ul. Sportowa 10, Numer KRS 0001109771, NIP 9282111808, REGON 52884314900000 (“Service Provider”).

§ 1 Definitions

  1. Service Provider – ZS Nieruchomości Sp. z o.o. 68-200 Żary, ul. Sportowa 10, Numer KRS 0001109771, NIP 9282111808, REGON 52884314900000.
  2. User – any natural or legal person using the Service.
  3. Services – electronic services described in § 2.

§ 2 Type and Scope of Services Provided

  1. The Service provides informational content regarding website development offers.
  2. The Service Provider enables Users to:
    – freely browse materials published on the Service
    – send inquiries via a contact form secured with Google reCAPTCHA,
    – subscribe to a free newsletter.

§ 3 Technical Conditions for Using the Service

  1. To use the Service correctly, you need: a device with Internet access, a current browser supporting HTML5, cookies, and JavaScript enabled.
  2. The Service Provider strives to keep the Service free from errors and malicious software.

§ 4 Conclusion and Termination of Service Agreement

  1. Using the Service begins when its content is displayed in the browser and does not require registration.
  2. The newsletter agreement is concluded once the User confirms their subscription (double opt-in) and remains in effect until unsubscribed via the “Unsubscribe” link in each message footer.
  3. The User may stop using the Service at any time by closing the browser tab; this action does not create any obligations.

§ 5 Copyright

  1. The content of the Service, including texts, graphics, and theme source code, constitutes a work within the meaning of the copyright law and is protected.
  2. Copying or distributing materials requires prior written consent of the Service Provider unless otherwise provided by law.

§ 6 Liability

  1. The Service Provider is not liable for damages resulting from the use of the Service in a manner inconsistent with the Terms or the law.
  2. The materials on the Service are for informational purposes only and do not constitute a commercial offer within the meaning of the Civil Code.
  3. The Service may contain links to third-party websites; the Service Provider is not responsible for their content or security.

§ 7 Complaint Procedure

  1. Complaints regarding the operation of the Service may be submitted via email to kontakt@ercoding.pl.
  2. The complaint should include information enabling the identification of the complainant and a description of the issue.
  3. The Service Provider will respond to the complaint within 14 days of receipt.

§ 8 Right of Withdrawal

The User may unsubscribe from free services at any time and without giving a reason, especially from the newsletter, using the procedure indicated in § 4(2).

§ 9 Personal Data Protection

Rules for the processing of personal data are defined in the Privacy Policy available at https://ercoding.pl/polityka‑prywatnosci.

§ 10 Changes to the Terms

  1. The Service Provider may change the Terms for valid legal or technical reasons.
  2. Newsletter subscribers will be notified of the changes by email at least 14 days in advance; other Users via a notice on the Service.
  3. Continued use of the Service after the effective date of the changes implies acceptance of the new version of the Terms.

§ 11 Final Provisions

  1. In matters not regulated by the Terms, the provisions of Polish law shall apply, in particular the Act on Electronic Service Provision.
  2. Any disputes will be settled by the court having jurisdiction in the matter.
  3. The Terms come into effect on the date of publication on the Service.
